A New Jersey Extreme Risk Protection Order (ERPO) is a legal tool designed to prevent individuals who pose a significant risk to themselves or others from possessing or purchasing firearms. This order can be requested by a family member, household member, or law enforcement officer if they believe someone is a danger due to violent behavior, mental health issues, or threats.
To obtain an ERPO, the petitioner must file a request in the Superior Court or with local law enforcement, providing evidence of the respondent’s dangerous behavior. If the court finds sufficient grounds, it may issue a temporary ERPO (TERPO), which New Jersey Extreme Risk Protection Order immediately prohibits the individual from possessing firearms or ammunition. A final hearing is then scheduled, where both parties can present evidence. If the judge determines the risk is ongoing, a Final ERPO (FERPO) is issued, enforcing the firearm prohibition indefinitely, subject to appeal.
